GDPR INFORMATION CLAUSE (Art. 13 GDPR)

Version A – Order form / Account creation

In accordance with Article 13 of Regulation (EU) 2016/679 (GDPR), we inform you that:

  1. The controller of your personal data is Borovita Sp. z o.o., Borowina Sitaniecka 78E, 22-400 Zamość, Poland, Tax ID (NIP) 9223087592, KRS 0001190677, e-mail: kontakt@borovita.com.
  2. Your personal data will be processed to conclude and perform the sales contract (including delivery and payment settlement) – legal basis: Art. 6(1)(b) GDPR – and to fulfil the Controller's legal obligations (accounting, tax, statutory warranty) – legal basis: Art. 6(1)(c) GDPR.
  3. Recipients of the data may include: courier and freight-forwarding companies handling delivery, payment operators, the accounting office, and IT/hosting service providers.
  4. Data will be stored for the duration of the contract and for the limitation period of claims and the period required by tax/accounting regulations (generally up to 6 years).
  5. You have the right to access your data, rectify it, erase it, restrict its processing, transfer it, and object to its processing.
  6. You have the right to lodge a complaint with the President of the Personal Data Protection Office (Prezes UODO).
  7. Providing your data is voluntary but necessary to conclude and perform the sales contract.

Version B – Newsletter sign-up / marketing consent

In accordance with Article 13 GDPR, we inform you that:

  1. The controller of your personal data is Borovita Sp. z o.o., Borowina Sitaniecka 78E, 22-400 Zamość, Poland, e-mail: kontakt@borovita.com.
  2. The e-mail address you provide will be processed to send newsletters and marketing information about the Store's products – legal basis: Art. 6(1)(a) GDPR (consent).
  3. You may withdraw your consent at any time, e.g. by clicking the unsubscribe link in the footer of any e-mail or by contacting the Controller, without affecting the lawfulness of processing carried out before withdrawal.
  4. Data will be processed until consent is withdrawn.
  5. You have the right to access, rectify, erase, restrict processing of, transfer, and object to the processing of your data, and to lodge a complaint with the President of the Personal Data Protection Office.
  6. Providing your data is voluntary.

Your data will be processed solely to respond to your inquiry – legal basis: Art. 6(1)(f) GDPR (the Controller's legitimate interest in handling correspondence) – and will be stored for as long as necessary to handle the inquiry and any applicable limitation period for claims.
